Smoke-free Apartments, Condominiums, and Multi-unit Dwellings:

Secondhand smoke seeping into apartments or condominiums from neighboring units poses a health risk and a significant nuisance.   Unfortunately, there are no fail-proof solutions to this problem.  Since personal dwellings are not considered public spaces, they are generally not covered under existing legislation regulating smoking in public places, though some municipalities may restrict or prohibit smoking in common areas.  Act 295, Hawai‘i’s Smoke-free Law, prohibits smoking in lobbies, hallways, and other common areas in apartment buildings, condominiums, and multi-unit dwellings.

For information on how to reduce multi-unit residents’ involuntary exposure to secondhand smoke, how to create smoke-free housing policies, and the benefits of such policies, contact the Hawai‘i State Department of Health, Tobacco Prevention and Education Program at (808) 586-4613; Toll Free (888) 810-8112.
